Article 4 of the EU AI Act is the obligation nobody talks about. What Article 4 Actually Says

The text is short enough to quote in full: “Providers and deployers of AI systems shall take measures to ensure, to their best extent, a sufficient level of AI literacy of their staff and other persons dealing with the operation and use of AI systems on their behalf, taking into account their technical knowledge, experience, education and training and the context the AI systems are to be used in, and considering the persons or groups of persons on whom the AI systems are to be used.”

Three things matter here. First, the obligation covers both providers (companies building AI) and deployers (companies using AI). If your sales team runs leads through an AI scoring tool, your company is a deployer. Second, “staff and other persons” includes contractors, freelancers, and anyone operating AI on your behalf. Third, the standard is not absolute perfection but “to their best extent,” which means proportionate effort based on context. A five-person startup using ChatGPT for email drafts has different obligations than a bank deploying AI credit scoring.

The European Commission published detailed guidance on what this means in practice. AI literacy, according to the official FAQ, is “the skill, knowledge and understanding that allows entities and/or individuals to make an informed deployment of AI systems and to gain awareness about the opportunities and risks of AI and possible harm it can cause.”

Who Is Covered

The scope is deliberately broad. According to the European Commission’s FAQ, there is no minimum company size, no sector limitation, and no exemption for low-risk AI use. The obligation applies to:

  • Companies that build AI systems (providers)
  • Companies that use AI systems in their operations (deployers)
  • Importers and distributors of AI systems
  • All staff who interact with, operate, or make decisions based on AI outputs
  • Contractors and third parties operating AI on the company’s behalf

Why AI Literacy Matters Beyond Compliance

The regulation exists because uninformed AI use causes real damage. The EU’s logic is straightforward. If your staff cannot evaluate when AI outputs are unreliable, they will make decisions based on flawed information. For companies already subject to high-risk obligations under Annex III, AI literacy is not separate from those requirements. It is foundational. The critical middle date is August 2, 2025. From that point, even without regulatory fines, companies face civil liability. If an employee without adequate AI training makes a decision based on faulty AI output that harms a consumer or business partner, the company can be sued. How to Build an AI Literacy Program That Actually Works

The European Commission deliberately does not prescribe a one-size-fits-all training curriculum. The official FAQ states: “There is no one size fit all when it comes to AI literacy and the AI Office does not intend to impose strict requirements or mandatory trainings.” Instead, companies have flexibility in designing programs that fit their context. But “flexibility” does not mean “optional.” It means you choose the method, not whether to act.

1. AI Fundamentals

Staff need a working understanding of what AI systems do and how they produce outputs. This does not mean teaching everyone machine learning. The goal: people stop treating AI as an oracle and start treating it as a tool with specific strengths and limitations.

3. Ethics and Bias Awareness

AI systems reflect their training data. If that data carries historical biases, so do the outputs. Staff need to understand that AI recommendations are not neutral and that human judgment remains necessary to catch discriminatory patterns, especially in employment, financial services, and public-facing applications.

4. Data Protection

AI literacy and data protection literacy overlap significantly. Staff need to know what data they can and cannot feed into AI tools, how GDPR constraints apply to AI processing, and why entering personal data into consumer AI tools creates compliance risk.

5. Practical, Role-Specific Application

A developer integrating an AI API has different literacy needs than a recruiter using an AI screening tool. Training must be differentiated by role. The IHK Hannover recommends mapping AI touchpoints across the organization first, then building targeted modules for each user group.

Role-Based Training: Who Needs What

Not everyone needs the same depth. The European Commission’s guidance emphasizes that training should account for “technical knowledge, experience, education and training” of the individual. Here is how to segment it.

Executive leadership needs strategic literacy: what AI can and cannot do, how it affects their industry, what regulatory obligations mean for business decisions, and how to evaluate AI investments. They do not need to understand transformer architectures. They do need to understand liability.

Middle managers who oversee teams using AI need operational literacy: how to evaluate AI tool outputs, when to escalate, how to document AI-assisted decisions, and how to ensure their teams comply with usage policies. These are the people who enforce human oversight in practice.

Frontline AI users (HR, sales, customer service, finance teams using AI tools daily) need practical literacy: what the tool does, what it does not do, when to trust its output, when to verify, and how to report issues. This is where training prevents the most common compliance failures.

IT and data teams need technical literacy: how AI systems are integrated, what monitoring is required, how to detect drift or degradation, and what logging the regulation requires.

Legal and compliance teams need regulatory literacy: the full text of relevant articles, how national authorities interpret requirements, what documentation to maintain, and how to handle incidents.

What Germany’s Works Councils Mean for AI Training

For companies operating in Germany, AI literacy training intersects with co-determination rights. Under Section 87(1) No. 6 and No. 7 of the Betriebsverfassungsgesetz (Works Constitution Act), works councils have co-determination rights over both technical monitoring systems and occupational health protections, which includes AI training programs.

The Springer Professional analysis of 2026 HR trends identifies KI-Kompetenz as a top priority, and the Zukunft Personal conference has dedicated entire tracks to it. But the practical implication for German companies is that the works council must be involved in designing and implementing AI literacy programs. This is not a suggestion. It is a legal requirement under the BetrVG.

Document everything. Record what training was provided, who completed it, when, and what competencies were covered. This is your evidence of “measures taken to their best extent” if regulators or courts ask.

Schedule ongoing updates. AI literacy is not a one-time course. When AI tools are updated, new tools are deployed, or regulations change, training needs refreshing. Set a quarterly review cycle.

Establish an AI use policy. Training without clear rules is incomplete. Define which AI tools are approved for which purposes, what data can be entered, what outputs require human review, and how to report problems.
