Straightforward for a traditional ML model with fixed inputs and outputs.

Now consider what actually happens at runtime. The agent decides which data sources to query. It selects which scoring rubric to apply based on the job description. It chains multiple tools: a resume parser, a skills extractor, a personality inference model, and a calendar API. Each decision introduces new data flows, new risk surfaces, and new compliance obligations that did not exist when the system was designed.

This is what CMS Law calls the “agentic tool sovereignty” problem: when an AI agent autonomously selects and invokes tools, responsibility disperses across model providers, system integrators, deployers, and tool providers. No single actor has complete visibility into the agent’s decision tree at the moment of execution.

The Provider-Deployer Boundary Collapse

Article 25(1) contains a trap that most agent operators overlook. If a deployer modifies an AI system’s intended purpose, or makes a “substantial modification,” the deployer becomes a provider. That means inheriting every provider obligation: quality management, conformity assessment, EU database registration, post-market monitoring.

The 10-Point Compliance Checklist

This checklist assumes your AI agent operates in an Annex III high-risk domain: employment screening, credit scoring, biometric identification, critical infrastructure management, education assessment, insurance underwriting, law enforcement, or migration processing.

1. Inventory Every AI Agent in Production

You cannot classify what you have not cataloged. Document every AI agent, including its purpose, input data types, output decisions, affected user populations, and your role (provider, deployer, importer, or distributor). An appliedAI study of 106 enterprise AI systems found that 40% had unclear risk classification. The inventory is where you fix that.

2. Classify Each Agent Against Annex III

Map every agent against the eight Annex III categories. Pay attention to the exception in Article 6(3): a system listed in Annex III is not high-risk if it does not pose a significant risk of harm and does not “materially influence” the outcome of decision-making. If your agent provides recommendations that a human always reviews and can override, document that workflow. It may be your strongest defense.

3. Determine Your Role: Provider or Deployer

If you built the agent from scratch, you are the provider. If you purchased a turnkey system and use it as-is, you are the deployer. If you assembled an agent from a foundation model, added custom tools, and deployed it in a high-risk context, you are almost certainly a provider under Article 25(1). Document your reasoning. Regulators will ask.

4. Build a Risk Management System (Article 9)

Article 9 requires a continuous, iterative risk management process covering the entire AI system lifecycle. For agents, this means:

  • Identify risks that emerge from the agent’s autonomy (tool selection, data access patterns, delegation chains)
  • Estimate likelihood and severity for each risk, including foreseeable misuse
  • Implement mitigation measures (guardrails, human oversight triggers, permission boundaries)
  • Test against defined metrics before deployment and after every significant update
  • Account for impacts on persons under 18 and other vulnerable groups

A static risk assessment written once and filed away fails this requirement. The regulation explicitly demands a living process.

5. Implement a Quality Management System (Article 17)

Article 17 requires a documented QMS covering regulatory compliance strategies, design and development procedures, testing and validation processes, data management, post-market monitoring, incident reporting, and accountability frameworks. For AI agents, the QMS must also address:

  • How agent behavior is versioned and tracked across updates
  • How tool integrations are validated before production use
  • How delegation chains (agent spawning sub-agents) are governed
  • How prompt templates and system instructions are managed as controlled artifacts

6. Prepare Technical Documentation (Annex IV)

Annex IV demands comprehensive documentation prepared before market placement and maintained for the system’s commercial lifetime plus 10 years. That includes: general system description, design specifications, development process, risk management measures, data governance documentation, performance metrics, and known limitations.

For agent systems, this is particularly challenging. The “system” is not a single model but an orchestration of models, tools, prompts, and retrieval pipelines. Document the architecture, every component’s role, and how data flows between them.

7. Design Human Oversight Mechanisms (Article 14)

Article 14 requires that high-risk systems be designed for effective human oversight. Human overseers must be able to understand the system’s capabilities and limitations, monitor operation, interpret outputs correctly, and override or disregard outputs at any time.

For autonomous agents, this creates a genuine architectural challenge. You need to design interrupt points where humans can inspect agent reasoning, review pending actions before execution, and halt workflows. A logging dashboard that nobody checks does not satisfy Article 14.

8. Conduct Conformity Assessment (Article 43)

For most Annex III systems, Article 43 allows self-assessment following Annex VI procedures. You do not need a notified body unless your agent performs biometric identification for law enforcement. But “self-assessment” does not mean “no assessment.” You must systematically verify compliance against every applicable requirement, document the results, and issue a CE marking and EU Declaration of Conformity.

Conformity assessment alone typically takes 6 to 12 months for complex systems.

9. Register in the EU Database (Article 71)

Before placing a high-risk system on the market, providers must register both themselves and the system in the EU public database. Deployers in the public sector must also register their use. Registration data includes system identification, intended purpose, provider details, and conformity status. The database is publicly accessible.

10. Set Up Post-Market Monitoring and Incident Reporting

Providers must implement proportionate post-market monitoring based on the system’s risk profile. Serious incidents must be reported to national authorities within 15 days. For AI agents, “serious incident” includes cases where an agent’s autonomous action causes or contributes to death, serious health damage, serious disruption of critical infrastructure, or violation of fundamental rights.

Automatic logging of system events must enable tracing operations back to specific inputs and decisions. If your agent processes 10,000 decisions per day, you need infrastructure that makes any single decision auditable.

The Digital Omnibus Wildcard

The honest answer to “do I actually need to comply by August 2, 2026?” is: probably not, but you cannot bet your company on it.

The European Commission proposed the Digital Omnibus on AI on November 19, 2025, pushing Annex III deadlines to December 2, 2027 and Annex I deadlines to August 2, 2028. The Council adopted its negotiating mandate on March 13, 2026. Parliament’s committees backed it with a 101-9 vote. Trilogue negotiations are expected to start in April 2026.

The delay is likely but not certain. Three things could derail it:

  1. Trilogue stalls. Parliament wants fixed backstop dates. The Commission originally proposed a flexible trigger tied to when harmonized standards become available. If they cannot agree, the original August 2026 date stays.
  2. National enforcers move independently. Only 8 of 27 member states have designated their national AI competent authorities, but some (France’s CNIL, Germany’s BNetzA) are already signaling they will enforce existing obligations.
  3. The compliance work is identical either way. Whether the deadline is August 2026 or December 2027, the same 10 requirements apply. The 16-month delay gives you more runway, not less work.

The Commission itself missed its February 2026 deadline to publish guidance on high-risk system obligations. CEN/CENELEC harmonized standards are still not final. The compliance infrastructure is being built while the clock runs.
